Apple Mac Book Giveaway October to February 2009

  1. Information on how to enter forms part of the conditions of entry. Entry to this promotion is deemed acceptance of these terms and conditions.
  2. Entry is open to Australian residents only. Employees and immediate families of Cengage Education are not eligible to enter.
  3. To qualify, entries must be received by the deadline date of the offer (24 days from the date printed on the enrolment form). The enrolment form must bear a stamp of eligibility and must be accompanied by the deposit or full course fee. The enrolment form must be signed in agreement with the terms and conditions of enrolment.
  4. The judge’s decision is final and binding. No correspondence will be entered into.
  5. The competition commences October 20, 2008 and closes February 5, 2009.
  6. The draw will be conducted on February 13, 2009 at 10.00am at the offices of Cengage Education– Level 1, 1 Waltham Street, ARTARMON NSW 2064. All eligible entries have an equal chance of winning.
  7. The winner will receive an Apple MAC BOOK 13" colour display, 120GB MB402X/A WHITE , 2.1GHz Intel Core 2 Duo, 1GB 667 DDR2 SDRAM - 2x512MB, 120GB Serial ATA drive @ 5400 rpm, Combo Drive (DVD-ROM/CD-RW), Keyboard/Mac OS, AirPort Extreme built-in, Bluetooth 2.0 built-in.   8. The winner will be notified by mail and by phone on February 13, 2009 and announced in The Australian newspaper on February 20, 2009.
  9. Prize is not redeemable for cash.
  10. The name and state of residence may be published by Cengage Education future promotional material unless notified otherwise.

“CENGAGE EDUCATION WEEKENDS AWAY GAME OF CHANCE” PROMOTION: CONDITIONS OF ENTRY

1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.

2. Any costs associated with accessing the promotional website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.

3. The promotion is open to residents of Australia aged 16 years or older who enrol in a Thomson Education (now Cengage Education) course in the manner required during the promotional period (as set out in Condition 8 below). Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the promotion and provide personal information about themselves. All entries of entrants who are under the age of 18 years and enter the promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental consent (as and where required) will be deemed invalid. The Conditions of Entry will bind the entrants and any parent or legal guardian who gives their consent (for entrants aged 18 years and under).

4. Directors, management and employees (and their immediate families) of the Promoter, TLC Marketing Worldwide Pty Limited, participating accommodation venues and agencies or companies associated with this offer are ineligible to enter the promotion.

5. The promotion commences at 12:01am (AEDT) on 14/1/2008 and closes at 11:59pm (AEDT) on 1/8/2008 and will be run over 6 promotional months as stated below in Condition 6. The start, close and draw dates and times (AEST) for each promotional month are as stated below in Condition 6. Each draw will take place at 5:00pm (AEST) at New Dialogue, Level 5, 65 York Street Sydney NSW 2000. All winners will be notified by telephone and mail or email and their name and locality will be published in The Australian on the following dates: Draw 1: 12/3/2008; Draw 2: 10/4/2008; Draw 3: 12/5/2008; Draw 4: 10/6/2008; Draw 5: 10/7/2008; Draw 6: 12/8/2008. All reasonable steps to notify winners of the results of draws will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.

7. Entries for a given promotional month that are not drawn as a winning entry for that promotional month’s draw are eligible for subsequent promotional month draws.

8. To enter the promotion, eligible entrants must enrol in any Thomson Education (now Cengage Education) course (excluding Degree in Accountancy; Advanced Diploma of Accounting; Business Management (Diploma); Diploma of Accounting; Certificate IV in Design; Human Resources (CERT IV); Small Business Management (CERT IV), Applied Social Science – Advanced; and Counselling & Communication) and remain enrolled in that course for at least twenty one (21) days (including the date of enrolment). Eligible entrants who cancel their enrolment within twenty one (21) days of the date of their enrolment are not eligible to enter the promotion. In order to enrol in the Thomson Education (now Cengage Education) course and enter the promotion, eligible entrants must, during the promotional period, call 1300 853 033 and then provide their full name, residential address, telephone number, current and valid email address and indicate which Thomson Education (now Cengage Education) course they would like to enrol in; OR log on to www.thomsoneducationdirect.com.au and complete in full and submit in the manner required the online enrolment form. In order to fully complete the online enrolment form, eligible entrants must provide their full name, residential address, telephone number, current and valid email address and indicate which Thomson Education (now Cengage Education) course they would like to enrol in Eligible entrants will automatically receive one (1) entry into the promotion for successfully enrolling in a Thomson Education (now Cengage Education) course during the promotional period after they have been enrolled in that Thomson Education (now Cengage Education) course for 21 days.

9. Multiple entries are permitted, but each entry must be based on enrolment in a separate Thomson Education (now Cengage Education) course and must fully comply with the entry requirements set out above. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the promotional period.

10. Prizes: For prize draw 1, the first twenty (20) eligible entries randomly drawn from all eligible entries received as at the date of that draw (ie, eligible entries received between 4/2/2008 and 29/2/2008) will each win one (1) prize. For prize draw 2, the first twenty one (21) eligible entries randomly drawn from all eligible entries received as at the date of that draw will each win one (1) prize. For prize draw 3, the first twenty two (22) eligible entries randomly drawn from all eligible entries received as at the date of that draw will each win one (1) prize. For prize draw 4, the first twenty two (22) eligible entries randomly drawn from all eligible entries received as at the date of that draw will each win one (1) prize. For prize draw 5, the first twenty one (21) eligible entries randomly drawn from all eligible entries received as at the date of that draw will each win one (1) prize. For prize draw 6, the first twenty four (24) eligible entries randomly drawn from all eligible entries received as at the date of that draw will each win one (1) prize. Each prize is two (2) nights accommodation for the winner and one (1) guest in a hotel, resort or apartment rated between 3.5 and 5 stars (inclusive) as selected by the winner from a list of participating hotels, resorts and apartments (as advised by the Promoter) in NSW, SA, WA, TAS, QLD, VIC and NT that will be displayed on www.tlc-rewards.com/cengage.

11. Accommodation will be in a standard room, twin share or double and is valued at up to $450.00 depending on the accommodation selected (Recommended Retail Price including GST). This offer may be taken at any time of the week (subject to accommodation availability), although the two nights accommodation must be taken consecutively. Children or additional adults sharing a room will incur additional costs, which will be quoted on request.

12. Prizes will be issued to winners within 28 days of the date each winner is drawn. Each winner will be sent an email by the Promoter within 10 days of being drawn as a winner, inviting them to log on to www.tlc-rewards.com/cengage and download a claim form. Winners must then download the claim form, print it out and complete it in full in the manner required. Winners must then mail in the stamped envelope the completed claim form and a copy of the claimant’s recent utility bill (eg gas, electricity, water but no more than 3 months old at the time of sending) to PO Box 441, Margate, QLD 4019. All claim forms must be received by the Promoter within 30 days of the date of the email sent by the Promoter to the winner inviting them to download the claim form. No claims sent by mail will be accepted by the Promoter after the dates stated above. The Promoter accepts no responsibility for late, lost or misdirected claim forms.

13. In order to fully complete the claim form, winners will be required to provide their full name, residential address, telephone number, current and valid email address and the name of the Thomson Education (now Cengage Education) course they enrolled in. Incorrect, incomplete or incomprehensible claim forms will be ineligible.

14. Each winner is limited to only one claim (made in accordance with these Conditions of Entry). Any subsequent claim after the first valid claim received from a winner will be invalid. Incomplete, ineligible or incomprehensible claims will be deemed invalid.

15. Within 10 days of the Promoter receiving a valid claim form from a winner, the Promoter will send the winner via email a uniquely numbered booking code. In order to book their accommodation, winners must log on to www.tlc-rewards.com/cengage and complete in full in the manner required and submit the online booking form. In order to fully complete the online booking form, winners will be required to provide their full name, residential address, mobile or home telephone number, current and valid email address, their uniquely numbered booking code and list their preferred 3 options of travel dates, accommodation options and locations. Booking must be received by the Promoter no less than thirty (30) days prior to the earliest requested accommodation date. If the accommodation requested by a winner is available, the booking will be confirmed via email within ten (10) days of receipt of an eligible booking form (unless the winner has requested to be contacted via telephone, in which case the booking will be confirmed via telephone). If the requested travel dates, accommodation option or location are unavailable, the claimant will be advised via email within seven (7) days of alternative dates, accommodation options or locations (unless the winner has requested to be contacted via telephone, in which case the winner will be advised via telephone). If a winner has difficulty with the online booking process, they may call 1800 464 465.

16. Internet booking forms will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete, ineligible or incomprehensible booking forms will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected booking forms.

17. Total maximum prize pool is up to $58,500.00 (Recommended Retail Price including GST). The prizes must be taken as offered and cannot be varied. The prizes, or any unused portions of the prizes, are not transferable or exchangeable for other goods or services and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.

18. All other costs including all transport to and from the accommodation, additional nights’ accommodation, meals, beverages, additional bedding, laundry services, spending money, insurance, travel insurance, and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the winner and their guest. Any part of a prize that is not taken for any reason is forfeited.

19. Each prize is subject to any prevailing terms and conditions of accommodation and service providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the winner, or their guest, are unable to use any element of the prize as stated for any reason that constitutes a breach of such prevailing terms and conditions or for any reason attributable to the winner or their guest.

20. The accommodation must be booked and taken in full by 10/8/2009 otherwise the entire prize is forfeited. All components of the prize must be taken together. Accommodation is subject to availability and blackout periods may apply. The offer has limited availability during peak periods and school holidays and accommodation may not be available during this time. If, however, a standard twin room is available at the time of request of booking, the winner will be booked into that accommodation. Once booked, any changes made to the booking will incur a $25.00 amendment fee (in addition to any charges that may be applied by the accommodation supplier), at the cost of the winner. Cancellations may also incur cancellation fees from the accommodation supplier. Accommodation is to be arranged by New Dialogue Pty Ltd or their agents.

21. Each winner must retain and may be required to present proof of purchase in order to claim a prize. Entrants may be requested to provide to the Promoter proof of purchase for all entries made. If an entrant is unable to provide proof of purchase for all entries made, then all the entries of that entrant will be ineligible and deemed invalid. Proof of purchase includes showing the original and providing a photocopy of the enrolment receipt for the Thomson Education (now Cengage Education) course they enrol in.

22. Entrants must only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm their identity, age, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion (including where a winner is aged 18 years of age, confirming consent of a winner’s parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent, and also confirming consent of a guest’s parent or legal guardian and the name, age and address of the parent or legal guardian where a guest is aged under 18) before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entrant has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

23. If a winner is aged under 18, the prize will be awarded to the winner subject to the winner’s parent or legal guardian (who consented to the winner entering the promotion) providing their consent for the claimant to receive the prize. If the winner’s guest is aged under 18, the winner’s guest will be required to provide evidence of their parent or legal guardian’s consent for the guest to accompany the winner.

24. It is a condition of accepting a prize that the winner (and their guest) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

25. The Promoter also reserves the right to request each winner’s guest to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm their identity and age before issuing a prize.

26. The Promoter may conduct such further draws at the same time and place as the original draw as is necessary on 6/11/2008 in order to distribute any prizes if unclaimed by that date, subject to any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA) or other State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winners will be notified by telephone and mail or email and their name and locality will be published in The Australian on 13/11/2008.

27. In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any written directions made under applicable State or Territory legislation, the Promoter reserves the right to either provide an alternative prize (including an alternative accommodation option or location at an alternative date as specified by the Promoter) to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.

28. If for any reason a prize becomes unavailable due to circumstances outside of the Promoter's reasonable control, the Promoter reserves the right to award a similar substitute (including an alternative accommodation option or location at an alternative date as specified by the Promoter) of equal or greater value, subject to any written directions made under applicable State or Territory legislation.

29. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

30. The Promoter, participating venues and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its agencies associated with this promotion will take no responsibility for claim forms or booking codes damaged or lost in transit.

31. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

32. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.

33. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

34. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

35. Caution: any attempt to cause malicious damage or interference with the normal functioning of the Promoter’s website or the information on the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.

36. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

37. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name, and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by calling 1300 853 033. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.

  2. If the student cancels within the 15 day cancellation period, the MP3 Player must be returned to Cengage Education unopened and in merchantable condition (along with the other learning materials), or the value of the missing/damaged goods will be deducted from the refund.
